COMPETITION RULES

MY LITTLE BIG THING SUSTAINABILITY CHALLENGE

MK-AFRICA has organised this Competition which aims to foster innovation in sustainability with a special focus on the Sustainable Development Goals. These Rules set out what You need to do to enter this Competition, the process of selecting the Winners and any restrictions or conditions that will be imposed on You.  It is very important for you to understand these Rules.  By entering the Competition, You agree to participate in good faith in accordance with these Rules.

  • Definitions
    • Application Form” means the online application form appearing on the Competition Website to be submitted together with the Entry;
    • Announcement Dates” means the dates when the Winners of the Prizes will be announced as provided for below;
    • Competition” means My Little Big Thing Sustainability Challenge, as more particularly described on the Competition Website www.mylittlebigthing.com ;
    • “Competition Period” means (“Opening Date: 10th May”) to (“Closing Date: 5th June”) inclusive;
    • Competition Website” means the Promoter’s website which contains further information on the Competition;
    • Entrant” or “You” means any person who meets the eligibility criteria in clause [•] below and submits an Entry into the Competition within the Competition Period;
    • Entry” means a 2 to 3 minute video together with any accompanying material uploaded onto the web portal on the Competition Website during the Competition Period;
    • “Grand Prize” means the ultimate prize to be awarded to the best three (3) Entrants of an all expenses paid trip to Pretoria, South Africa to receive training on sustainability from Cambridge University, South Africa and the opportunity to see real life projects on sustainability.
    • Prizes” means the prizes as described below;
    • Promoter” means Muthoni Kanyana Consultancy Limited, a limited liability company incorporated under the laws of the Republic of Kenya under registration number CPR/2015/186048 and of P.O. Box number 60957 – 00200, Nairobi, trading as “MK-Africa”;
    • Rules” means these Competition Rules, as they may be updated from time to time;
    • Sponsors” means the organisations or companies which will provide the Prizes and/or funding for the Competition; and
    • Winners” means the best twenty (15), best ten (7) and best three (3) Entrants.

 

  • Eligibility Criteria
    • You must comply with the following requirements in order to be eligible to enter the Competition.
      • You must be a registered undergraduate student in a University or Polytechnic in Kenya;
      • You must not be a director, member, partner, employee, franchisee, agent of, or a consultant to the Promoter, nor an immediate family member, employee, business partner and/or business associate of such director, member, partner, employee, franchisee, agent or consultant or marketing service provider in relation to this Competition;
      • You must submit Your entry through the web portal on the Competition Website no later than [•] Kenya time on the Closing Date. All Entries received after the Closing Date will be automatically disqualified.
      • Your Entry must be in English, in [•] format and accompanied by the Application Form. All compulsory sections of the Application Form must be completed. Failure to do so may result in the rejection of the Entry.
      • Each Entrant can only submit one Entry.
      • Your Entry, once submitted cannot be recalled or cancelled.
    • The Promoter reserves the right to disqualify an Entrant if an Entrant’s conduct is contrary to the spirit or intention of the Competition.

 

  • How to Enter
    • Enter the Competition online by creating an online account on the Competition Website then submitting the Entry and completing the Application Form no later  than 9th June.
    • There is no charge for taking part in the Competition.

    • After the Closing Date, the Entries will be judged to determine which Entries are the best as set out in clause 4 below.
    • The Promoter will not accept:
      • responsibility for Entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or
      • transmission as proof of receipt of entry to the Competition.

Applicants are therefore strongly advised to submit their Entries well before the Closing Date.

 

  • The Selection Process
    • A panel of judges (the “Panel”) will judge the Entries. The judging criteria are set out on the Competition Website. All submissions to the Panel will be anonymised.
    • The Panel will select the best fifteen (15) Entries from those submitted.
    • The best fifteen (15) Entrants will be awarded the Prize of receiving training at Strathmore Business School, Nairobi.
    • Upon completing the training, the best fifteen (15) Entrants will be required to pitch their Entries to [another/the same] panel of judges who will shortlist the best seven (7) Entries.
    • The Promoter will then publish the best seven (7) Entries on social media and invite the public to vote for the best Entries among those published.
    • The results of the public vote will be used to select the best three (3) Entries.
    • The best three (3) Entrants will be awarded the Grand Prize. Upon their return, the best three (3) Entrants will be posted as interns to one of the Sponsors for a period of three (3) months.

 

  • The Prizes
    • The Prizes are:
      • Training opportunity at Strathmore Business School for the best fifteen (15) Entrants;
      • The Grand Prize.
  • The Prizes are non-transferable and there will be no cash alternatives.
  • The Panel’s decisions and the result of the public vote in respect of the best fifteen (15), best seven (7) and best three (3) Entries respectively are final and no correspondence will be entertained or entered into.

 

  • Announcement of Winners
    • The winners of the Competition will be announced as follows:
      • The best fifteen (15) Entries will be announced;
      • The best seven (7) Entries will be announced; and
      • The best three (3) Entries will be announced.
    • The Promoter shall contact the Winners by telephone and by email personally as soon as practicable after the Announcement Dates and the names of the Winners will be displayed on the Competition Website.
    • Winners of the Prizes will be contacted a maximum of three (3) times. If the Promoter is unable to contact a Winner within five (5) business days after the Announcement Date, the Prize to that Winner will be withdrawn and the next best Entry will be selected for the Prize.
    • The Promoter does not accept any responsibility if You are unable to take up the Prize.
    • The award of all Prizes will be subject to the authentication of the identity of the Winner through presentation of an original Kenyan National identity card or a valid passport.

 

  • Limitation of liability 
    • The Promoter shall not be liable to any Entrant, their legal representatives or any third party for any losses, damages, costs, claims, injuries or death in connection with their entry into the Competition, which includes, without limitation, the selection of the winners, the terms and conditions set out in these Rules, the Prizes or use of any Prize (except for harm or loss that is caused directly by the gross negligence of the Promoter, its agents).
      • This clause means that You will be entering the Competition at Your own risk and the Promoter will not be responsible to You, or any other third party, for any harm You, or a third party, may suffer as a result of entering the Competition. 
      • If You or any third party sustains any loss, injury or death in connection with entry into the Competition, the selection of Winners, any of the Prizes or making use of any of the Prizes, You or that third party will not be able to sue, or make any other claim against, the Promoter or any of their directors, employees or any agents. 
      • If any third party suffers harm because of Your participation in the Competition, You may be responsible to the third party and not the Promoter.
    • The Promoter reserves the right to suspend or terminate the Competition for any valid technical or commercial reason.
    • The Promoter may amend these Rules at any time before or during the Competition Period and will put a notification of the amendment on the Competition Website. The Promoter shall not incur any liability in this regard.

 

  • Ownership of Entries and Intellectual Property Rights
    • All Entries submitted to the Promoter will become the property of the Promoter on receipt and will not be returned.
    • By submitting Your Entry, You agree to:
      • assign to the Promoter all Your intellectual property rights with full title guarantee; and
      • waive all moral rights; in and to Your Entry and otherwise arising in connection with Your Entry to which You may now or at any time in the future be entitled under the Copyright Act, 2001, Laws of Kenya and the Industrial Properties Act, 2001, Laws of Kenya as amended from time to time and under all similar legislation from time to time in force anywhere in the world.
    • You agree that the Promoter may, but is not required to, make Your Entry available on the Competition Website and any other media, whether now known or invented in the future, and in connection with any publicity of the Competition.
    • You agree to grant the Promoter a non-exclusive, worldwide, irrevocable licence, for the full period of any intellectual property rights in the Entry to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-licence the Entry.

 

  • Personal Information 
    • The Promoter will collect, process, transfer and keep certain information about the Entrants and Winners for the purposes of the Competition and also to comply with any local legislation. This information may include but may not be limited to Your name, age, identity number, contact details and other information obtained as a result of Your entry in the Competition (“Personal Information”).
    • All Personal Information, will be:
      • used solely in connection with the Competition; and
      • transferred to the Promoter and the Promoter’s agents for the purposes of the Competition in order to confirm that You satisfy the requirements of these Rules; and,
      • used in any reasonable publicity required by the Promoter in connection with the Competition.
    • By entering the Competition, You consent to Your Personal Information being transferred to the Promoter’s database that may be located outside of Kenya for use as envisaged in this clause 9. 
    • The Promoter shall keep Your Personal Information secure and store it in accordance with all applicable laws and will not transfer such information to any third parties other than as permitted and consented to by You in terms of these Rules or as may be required in law.
    • In case You wish to remove or update the Personal Information provided, You may do so by following the “Stop receiving these promotional emails or “opt out” option on the bottom of the viral confirmation of entry email, SMS or go to the Competition Website.
    • Reasonable steps will be taken to ensure that Your Personal Information is treated securely and is safeguarded against any loss, damage, destruction of or unauthorised access.
    • By entering the Competition, You consent to the Promoter using Your Personal Information in the manner set out in this clause 9. 

 

  • General Provisions
    • If there is any reason to believe that there has been a breach of these Rules by You, the Promoter may, at its sole discretion, exclude You from participating in the Competition.
    • These Rules are governed by and will be interpreted in accordance with Kenyan law and any disputes arising out of them will be subject to the exclusive jurisdiction of the courts of Kenya.
    • By participating in the Competition, You consent to be bound by these Rules.
